Am I legally justified in applying for a divorce?
Perhaps you haven’t even applied for a divorce yet.  Whilst we are sure there are perfectly valid reasons behind every divorce, in theory the law will only accept your application if you have been married for a minimum of twelve months and “the marriage has broken down beyond repair.”  To show this, you must prove one of the four following facts:
Your spouse has abandoned you for a period of two years or longer
Your spouse has acted in unreasonable manner such that you can no longer be expected to live together.
Your spouse has acted committed adultery resulting in you can no longer being expected to live together.
You and your spouse have been living in separate accommodation for a period of two years or longer, and both of you agree to a divorce.
An alternative to divorce: separation
Should you have difficulty in applying for a divorce or for one reason or another (you may have been married for less than twelve months, for example), or you wish to stay legally married to your spouse, you can apply for a “judicial separation.”  The reasons for separating are legally the same as those for divorce and you must fulfil one of the above four.  In addition, the process of applying for a separation is easier and quicker than divorce.
